Programming.Team – Terms of Service

These Terms of Service (“Terms“) form a legally binding agreement between you (“you“, “User“) and Groundbreaker Solutions LLC DBA Programming.Team (“Programming.Team“, “we“, “our” or “us“) governing your access to and use of the Programming.Team website, mobile applications, widgets, APIs, and related services (collectively, the “Service“). By accessing or using any part of the Service you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You may use the Service only if you are at least 13 years old (or the legal age of majority in your jurisdiction, whichever is higher) and are otherwise capable of forming a binding contract with us. By using the Service, you represent and warrant that you meet these requirements and that all registration information you submit is accurate and complete.
2. Description of the Service
Programming.Team provides AI‑powered resume‑tailoring tools, a marketplace for resume templates and related digital products, and community resources designed to help Users improve their career materials. Some features are free; others require a paid subscription or one‑time purchase (collectively, “Paid Services“).
3. Account Registration & Security
Certain features require an account. You agree to provide true, current, and complete information during registration and to update it as needed. You are responsible for safeguarding your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access or use.
4. Fees, Payments & Revenue Sharing
- Pricing. Prices for Paid Services are displayed at the point of purchase and are subject to change at any time before you complete a transaction.
- Payment Processing. All payments are processed via Stripe, Inc. (or its affiliates). By purchasing, you authorize us and Stripe to charge your payment method for the full amount, including applicable taxes.
- Creators & Revenue Share. If you submit digital products for sale on the Service (“Creator“), you must have a valid Stripe Connect account linked to your profile. Programming.Team will remit 60 % of Net Revenue from each completed sale of your product to your connected Stripe account, typically within 7 days of our receipt of funds, subject to Stripe’s schedules and policies. “Net Revenue” means gross proceeds less platform fees, chargebacks, refunds, taxes, and payment‑processor fees.
- Refunds. Refund requests are handled in accordance with our Refund Policy. We may deny refunds on digital goods already delivered.
5. Licenses
5.1 License to Users
Subject to your compliance with these Terms, Programming.Team grants you a limited, non‑exclusive, non‑transferable, revocable license to access and use the Service for your personal, non‑commercial purposes.
5.2 User Content
You retain ownership of content you upload or submit (“User Content“). By posting User Content, you grant Programming.Team a worldwide, royalty‑free, transferable, sublicensable license to host, store, display, reproduce, modify, adapt, publish, and otherwise use your User Content for the purpose of operating and improving the Service and marketing your publicly listed products. You represent that you have all rights necessary to grant this license.
6. Prohibited Conduct
You shall not, directly or indirectly:
- Violate any applicable law or regulation;
- Infringe the intellectual‑property or privacy rights of others;
- Upload malicious code, conduct security testing without authorization, or interfere with the Service;
- Use automated means (bots, scrapers) without our prior written consent;
- Misrepresent your identity or the nature/origin of any content or template you submit;
- Engage in any activity we deem harmful to other Users, our community, or our infrastructure.
7. Intellectual Property
The Service, including all software, designs, trademarks, and content (excluding User Content), is owned by Programming.Team or its licensors and protected by intellectual‑property laws. Except for the limited license in Section 5, we reserve all rights not expressly granted.
8. Feedback
Any suggestions, ideas, or feedback you provide are non‑confidential, and we may use them without compensation or attribution.
9. Third‑Party Services
The Service may contain links to third‑party websites or services (e.g., YouTube, GitHub). We do not endorse, and are not responsible for, those services. Your interactions with third parties are solely between you and the third party.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, PROGRAMMING.TEAM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error‑free, secure, or that results obtained from its use will be accurate or reliable. AI‑GENERATED OUTPUT MAY CONTAIN INACCURACIES; YOU ASSUME FULL RESPONSIBILITY FOR VERIFICATION AND USE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL PROGRAMMING.TEAM, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) $100 USD OR (B) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to defend, indemnify, and hold harmless Programming.Team and its affiliates from any claims, damages, liabilities, and expenses arising out of or related to your (a) use of the Service, (b) violation of these Terms, or (c) infringement of any third‑party rights.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, all licenses granted to you will cease; Sections 7, 8, 10–15 survive termination.
14. Modifications to the Service and Terms
We may modify the Service or these Terms at any time. We will post updated Terms on the site and revise the “Effective Date.” Your continued use after changes become effective constitutes acceptance. If you disagree, you must stop using the Service.
15. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Delaware, U.S.A., without regard to its conflict‑of‑law provisions. Any dispute arising under these Terms will be resolved through binding arbitration administered by JAMS under its Streamlined Rules in Chicago, Illinois. Each party waives the right to a jury trial and to participate in class actions. Nothing prevents either party from seeking injunctive relief in court to protect intellectual‑property rights.
16. International Users
Programming.Team is based in the United States. If you access the Service from other jurisdictions, you do so on your own initiative and are responsible for compliance with local laws. We do not represent that the Service is appropriate or available elsewhere.
17. Miscellaneous
These Terms constitute the entire agreement between you and Programming.Team regarding the Service and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right is not a waiver. You may not assign these Terms without our prior written consent; we may assign them freely.
